GENERAL POLICY (sample)




I. GENERAL POLICY

    (Name of business) is committed to providing a safe, efficient and productive work environment. Within that environment, employees are expected to perform assigned duties while providing the highest level of quality service to our current and prospective customers. While (name of business) has no intention of intruding into the private lives of its employees, drug and alcohol use that affects job performance or public or personal safety, whether done on or off the job, will not be tolerated. Violations of this policy may result in disciplinary actions including suspension, demotion, reduction in salary step, or termination. In addition, the appropriate law enforcement agency will be notified if an employee is found to be using or in illegal possession of drugs or controlled substances while on the premises, during normal working hours, or during company sponsored events. 


    (Name of business) reserves the right to conduct searches of an employee’s personal effects, lockers, lunch containers, purses, luggage, etc., located on the company’s premises or be under

 the influence of drugs, alcohol, or a controlled substance. Entry onto company property or work site constitutes consent by employee to said searches and inspections

    Employee will be required to sign a written consent to such search and inspection at the time of a search. In the absence of adequate justification, refusal to consent may result in immediate termination.

To ensure a drug-free workplace, hiring of a new employee will be contingent on that candidate’s taking and passing a pre-employment drug screening test.

    Further, in the event of any on-the-

job injury or accident for which there is reasonable suspicion that illegal drugs may have been involved, drug testing may be required and the above policy applied. In the absence of adequate justification, refusal to be tested may result in immediate termination.

II. SUBTANCE ABUSE POLICY (Sample)

(Name of business) ‘s substance abuse policy recognizes that employee involvement with alcohol or drugs can be extremely disruptive and harmful in the workplace.  Accordingly, this policy requires all employees to report to work fit to perform their jobs.  All employees must adhere to the following rules:

     Employees shall not be under the influence of nor in possession of unsealed alcoholic beverages containers or drugs while on company property, in company vehicles, or at other company work locations.  Certain company social functions may involve the lawful use of alcohol.

     Employees shall neither sell nor provide drugs or alcohol to any other employee or person while either employee is on duty or paid standby.

     Employees who report to work impaired as a result of using alcohol or drugs, including lawful prescriptions ordered by a physician, will face disciplinary action and/or be required to seek counseling.

     Employees found to posses illegal substances will be reported to the appropriate authorities and immediately terminated.
    
Managers and/or supervisors are responsible for enforcement of the company substance abuse policies.

     Any employee who has reason to believe that controlled substances or alcoholic beverages are being manufactured, distributed, dispensed or used on company premises or during work shall immediately notify his or her supervisor. 

     An employee who voluntarily admits to and seeks to overcome a substance abuse problem may be encouraged to enroll in a rehabilitation program acceptable to the company.  Upon successful completion of said program, the employee may be allowed to return to work.  However, more frequent monitoring, including random drug testing of the employee may be required.

     All drug testing will be done by a qualified laboratory and all reasonable precautions will be taken to maintain the confidentiality of the test results.

     The company shall inform all new and current employees of these policies and educate employees about the dangers of substance abuse and how to halt such activities.
